These Terms and Conditions apply to all deals for the provision of our facilities and services, and supersede any other Terms and Conditions you may have previously received. By using the Website and/or our services you agree to be bound by these Terms and Conditions (the “Agreement”).

These terms and conditions describe the contract, rights and responsibilities of all parties entering into a rental agreement between you (“Customer”), any third party supplier (“a/the Supplier”) and Lurento.com, owned and operated by Goldenage Technologies OÜ, Narva mnt 38-40E, Tallinn, Estonia, registration number: 12943267, herein referred to as Us, We or GAT. If you are using our Website and our services you are contracting with GAT with respect to any payments or payouts from or to you conducted through us.

The Website is operated by GAT. The term Customer/You refers to the customer using the Website and/or booking a reservation through us on this Website or through our Customer service representatives (CSRs).

Read this Agreement carefully and save it. If you do not agree to be bound by this Agreement and to follow all applicable laws, you should not use the Website and/or our services.

This Agreement will remain in full force and effect while you use the Website and/or our services. You may terminate your usage at any time. Even after your usage is terminated, this Agreement will remain in effect.

Definitions

GAT means the features and services we make available, including through our Website, CSRs, and any other GAT branded or co-branded websites (including sub-domains, international versions, widgets or apps) now existing or later developed

Scope of Services

GAT connects Customers and Suppliers. By making a reservation through GAT, you are entering into a contract directly with the Supplier and you will be subject to their terms and conditions. The terms and conditions of a Supplier will be available to you prior the reservation confirmation by the Customer. By confirming your reservation you are accepting the Supplier’s terms and conditions and the Agreement.

Our Agreement with you sets out what you are legally entitled to expect from us when you make a reservation using GAT.

From the point at which you make your reservation, we act solely as an intermediary between you and the Supplier, transmitting the details of your reservation to the relevant Supplier and sending you a confirmation email for and on behalf of the Supplier.

You enter into a rental agreement with the Supplier. GAT shall not be liable itself or vicariously through the suppliers for either a failure to perform or delay in performing any of its obligations under or pursuant to this booking, voucher, reservation, rental or terms and conditions, if and in so far as performance is delayed and hindered, or if performance is prevented by force majeure, which expression shall mean any event beyond the reasonable control of the party in question.

Limitations

Age limitations

In most cases the minimum age required to enter into a rental agreement with our Suppliers is 25 years. Extra charges may apply in some jurisdictions or by some suppliers for drivers under 25 years and over 65 years of age. The age limit will be clearly displayed before you confirm your reservation.

For any extra charges in case of deviation in age limit or a change in car rental age policy, please refer to the terms and conditions of the Supplier. Any losses incurred as a result of failure to adhere to the age restrictions are the sole responsibility of the renter.

Flight and other delays

In the case of flight or other delays to vehicle delivery the Customer must inform us as soon as possible. We will attempt to adjust the delivery time for you in accordance with your delay but this may not always be possible and in such cases the Supplier may introduce a charge for the delay or for losses incurred by them as a result of the delay in accordance with the Supplier’s terms and conditions.

Driving areas

If you intend to drive to a country other than that where the vehicle is delivered/collected you must inform us before placing a reservation as certain restrictions may apply. A Supplier’s permission will be required for such trips. Failing to inform us may result in delays/charges/losses for which we are not responsible.

Pricing and Payments

You acknowledge that GAT pre-negotiates certain rates with Suppliers to facilitate the reservations on your behalf. The rate displayed on the Website or received from the CSRs is a combination of the pre-negotiated rate for services reserved on your behalf, the reservation fee retained by us to compensate us for our services and processing fees. All rates displayed on the website are in Euros (€) and applicable taxes are included.

Reservation and processing fee (“Service fees”) is not refundable unless in cases specified under “Cancellation policy”.

You authorise GAT to book reservations for the total reservation price, which includes the rate displayed on the Website. Upon submitting your reservation request you authorise GAT to facilitate reservations on your behalf.

GAT will charge a certain percent of total rental price, shown as “Service fees”.

The price displayed includes total rental price for the vehicle for the selected dates and includes delivery and collection cost, if applicable. Information about driving allowance limit will be displayed before you submit your reservation. Fuel is not included in the total rental price. Supplier may charge additional amount according to their Terms and Conditions.

All services require a deposit or a full payment at the time of booking for you to secure your car rental. Any outstanding balance is due to be paid to the Supplier prior to consuming services you’ve requested as specified in Supplier terms and conditions. If you do not pay your balance prior to consuming the services, the Supplier may cancel the reservation and charge cancellation fees as set out in the Supplier terms and conditions. Please read Supplier terms and conditions before making a reservation.

GAT may decline to commence any reservation until we receive a confirmation from our payment processing provider and/or bank. You agree that we are not responsible for any failure of our payment processor and/or bank to remit payment to us that you may make through them, or any failure on their part to notify us of payment, and that in such cases, it is your duty to resolve the matter directly with our payment processor and/or bank before we will acknowledge any payment by you.

Payments can be accepted by bank transfer or credit or debit cards. For payment instructions of the deposit by bank transfer please contact us.

GAT will charge only the amount displayed on the website or communicated by our CSR at the time of booking. GAT is not responsible for currency exchange rates or bank fees. If you’re paying via bank transfer, the invoice you’ll receive will include bank transfer fees or discounts.

Each Supplier may accept different payment methods as specified in Supplier terms and conditions. GAT holds no responsibility if Supplier is unable to process your payment for any reason or does not accept payment methods you want to use. Customer may require to sign credit card authorization form per Supplier’s request.

All payments must be processed successfully. If however, you do not complete your payment, all monies processed will be forfeited, and your booking will be cancelled. For avoidance of any doubt, the Customer confirms and accepts that partial payment shall not be considered as agreement for partial performance of the services by GAT or the Supplier.

Security deposit

Each Supplier defines required security deposit. The amount of required security deposit is specified for each vehicle. Security deposit is 100% refundable, except in situations specified in Supplier terms and conditions.

Pricing errors

The price of the rental services will be as quoted on the Website, except in cases of obvious error. Prices are liable to change at any time, but changes will not affect reservations already confirmed by GAT. Despite our best efforts, some of the services listed on the Website may be incorrectly priced. GAT is under no obligation to provide services to you at an incorrect price, even after you have been sent confirmation of your booking.

We expressly reserve the right to correct any pricing errors on our Website and/or on pending reservations made under an incorrect price. In such event, if available, we will offer you the opportunity to keep your pending reservation at the correct price or we will cancel your reservation and you will receive a full refund.

Supplier’s terms and condition

Supplier’s terms and conditions shall apply to your reservation and you are obliged to accept Supplier’s terms and conditions in order to make a reservation. Please read supplier’s terms and conditions carefully. You agree to abide by the terms and conditions imposed by any Supplier, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of vehicles. We reserve the right to cancel your booking if full payment is not received in a timely fashion. You acknowledge that suppliers offering services may require you to sign their liability waiver prior to participating in the service they offer. You understand that any violation of any such supplier’s rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable services, and in your forfeiting any monies paid for such a reservation.

Cancellation and refund policy

By making a reservation, you accept and agree to the relevant cancellation and no-show policy of that Supplier, and to any additional terms and conditions of the Supplier that may apply to your reservation, including for services rendered. The cancellation and no-show policy of each Supplier is included in Supplier terms and conditions which is available on our website and in the confirmation email. Please note that certain rates are not eligible for cancellation or change. Please check the Supplier’s terms and conditions thoroughly for any such conditions prior to making your reservation.

Cancellation by Customer

Reservation can be cancelled at any time. Any cancellation or amendment request must be sent to us in writing (emails are accepted) by the person who made the reservation and will not take effect until received by us. Once we receive the cancellation request, we will notify the Supplier and you will receive a confirmation that your reservation has been cancelled.

You may receive a refund in accordance with the Supplier’s cancellation policy as specified in Supplier’s terms and conditions. You may be charged for your cancellation in accordance with the Supplier’s cancellation policy. Please read the cancellation and no-show policy of the Supplier carefully prior to making a reservation. Service fee is not refundable if the cancellation was made by customer.

Cancellation by Suppliers

The Customer is aware and accepts that GAT acts only to connect the Customer and the Supplier and the Customer’s contract is with the Supplier, therefore the Supplier’s cancellation policy shall apply.

If a Supplier cancels a confirmed reservation the following shall apply: (i) GAT will refund the total amount for such reservation which was paid to GAT (Service fee), to the Customer within a 30 days period, by the same payment procedure as the payment was performed by the Customer, or (ii) the Customer will receive an email or other communication from GAT containing alternative vehicle and other related information. If the Customer requests a reservation of the alternative vehicle and the Supplier associated with such alternative vehicle confirms the Customer’s requested reservation, then the Customer agrees to pay GAT the amount relating to the confirmed reservation for the alternative Vehicle, in accordance with this Agreement and Supplier’s terms and conditions.

If the Customer and the Supplier make mutual agreement in respect to alternative vehicle, upon confirmed reservation, the Customer agrees to pay GAT the amount relating to the confirmed reservation for the alternative Vehicle, in accordance with this Agreement and Supplier’s terms and conditions.

Suppliers have the right to deny a vehicle or refuse to accept booking from any person or persons deemed unfit to drive or ineligible to meet the requirements. GAT should not be held responsible for completion of travel arrangements, compensation, cost or any refund in such cases. In this case Supplier’s cancellation policy shall apply.

No-show policy and unused services

Neither GAT nor its authorised representatives shall offer or pay any discounts or refunds for missed or unused services which were missed or unused by the Customer due to no fault of GAT or the Suppliers, which shall include any termination of the Customer’s participation in the service due to the Customer’s own fault, negligence or breach of these Terms.

No refund will be issued if you do not show up to collect your rental car at the agreed location, date and time.

Making changes to your booking

We do not guarantee to agree to changes to any confirmed reservation. In most cases we will do our best to accommodate your request but we make no guarantee to facilitate your changes. A charge may be applied to changes to your reservation. As soon as you are aware of any change requirements you should contact us as soon as possible. Failure to notify us of any changes to delivery/collection locations, time or date, or any other part agreed in your reservation may result in the cancellation of your reservation in which case no refund will be made.

If we make changes to your booking

In some instances the Supplier may change the details of your reservation. In such cases we will inform you as soon as possible as to the extent of the changes. If the changes are not acceptable to you and we are unable to make a suitable agreement between you and the Supplier we will offer a full refund of any monies received by GAT from you in relation to the booking. We hold no extra liability in terms of any direct or indirect loss suffered by you as a consequence of any changes made by our Suppliers.

We reserve the right to terminate any reservation agreement at any time. In such cases you will be informed as soon as is reasonably possible. In these cases any monies received from you by GAT will be refunded in the same payment manner. Reasons for cancellation may include, but are not limited to, technical or system errors, changes to local or national law, or any unforeseen circumstances that affect your rental or the Supplier. In the case of a cancellation during a rental period the vehicle must be returned to the Supplier immediately upon request.

Force majeure

We do not accept any liability of whatever nature for the acts, omissions or default, whether negligent or otherwise, of those vendors in connection with your travel pursuant to a contract between them and yourselves and over whom we have no direct control.

We do not accept liability in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force or other events which are beyond our control, or which are not preventable by reasonable diligence on our part including, but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of Government or of any other authorities, accidents to or failure of machinery or equipment or industrial action.

Complaints

As your contract is with the Supplier, all complaints should be addressed to them but we will assist you with any queries, concerns or disputes you may have relating to your arrangements. If you have a problem while using services provided by the Supplier, this must be reported to the Supplier or their representative immediately. If you fail to follow this procedure there will be less opportunity to investigate and rectify your complaint. If you wish to complain when you return home, please write to GAT and to the Supplier. You will see their contact details on the confirmation documents we send you. It is very important for us to keep our clients satisfied. We will do our best to assist you if required.

Insurance and Safety

GAT recommends that Suppliers obtain appropriate insurance for their vehicles. Please review any insurance policy of the Supplier related to the vehicle that you reserved, in particular please make sure that you are familiar with and understand any exclusions to, and any deductibles that may apply for such insurance policy.

Documentation

Once you receive your confirmation e-mail, please check it carefully to make sure that all details are correct and also ensure that the names given are the same as in the relevant ID documents you will present to the Supplier. If you believe one or more details are not correct, please contact us. Please ensure you check the information provided so that you are fully aware of timings, durations, departures and other details. If you are unsure about any aspect of your trip please contact our CSRs.

We do not accept responsibility for any activity or procedure that may be necessary in order to enjoy the use of our services, this is including but not limited to procuring or having in possession any passport or valid identification for travel. That is the sole responsibility of the user. Safety procedure of keeping your documents is part of our Privacy Policy.

Required documents

GAT or the Supplier may request personal identification documents to verify driver and cardholder data, including but not limited to passport, national id and driver’s license. Customer is required to send scanned or photographed images of the documents requested to confirm the reservation or prior to consuming services.

During the reservation process we will make requests for certain documents from you for yourself and any additional drivers. This could include, but is not limited to, driving license, passport, personal ID, and payment authorization form. It is your responsibility to ensure the validity of any documents you provide. Failure to do so could result in the termination of your reservation in which case no refund will be offered. If we suspect you have made a deliberate attempt to rent a vehicle under false pretenses we will be required by law to inform the local authorities. We are in no way responsible for any losses incurred by you or any third-party as a result of fraudulent or otherwise invalid documents provided by you.

Driving license

In order to rent any vehicle from us you must hold a full and valid driving license in your home country. You are responsible for obtaining an International Driving License or any other necessary permit. GAT is not responsible for any change to local or national laws regarding driver license requirements and it is your responsibility to ensure you are entitled to drive a vehicle in your destination country.

We must be informed at the time of booking of any endorsements or penalties on your driving license. Failure to do so may result in the refusal or the cancellation of a reservation. You must have your driving license and any necessary permits with you at any time you are in the rented car and you must provide it for inspection to local authorities when requested. A Supplier has the right to refuse to deliver a vehicle or honor the reservation agreement with you if you fail to provide your driving license at the time of delivery. In such cases no refund will be made.

The information displayed on these pages tells you how you can use these services, tools and functionality to find out about and make a reservation, view content, interact with us and submit and share views with other customers.Your use of this Website in these ways is subject to these Terms and Conditions that incorporate our Customer Review Rules which set out the terms upon which you are able to submit reviews and content to us related to our products and services.

Customer Review Rules

You may submit your reviews, comments, rental and driving experiences (“Reviews”) and they are subject to our privacy policy. We reserve the right not to publish reviews, to amend content of reviews at any time and to remove reviews from this website without notice after publication at our sole discretion.

By submitting Reviews, you are granting GAT a nonexclusive, perpetual, royalty-free, irrevocable and fully sub licensable right to use, reproduce, modify, adapt, publish, translate, distribute and display such content worldwide via any media.

If you are offended by any content of a review or become aware of any postings that are in any way defamatory or in breach of the Terms of Use and/or Rules please let us know by contacting our Customer service and we shall endeavour to remove any offending material.

Maintenance of Website

Due to maintenance work, we reserve the right to alter, update, or cancel our Service at any time. We may conduct such maintenance for security reasons, intellectual property or other reasons at our discretion, and we are not required to explain such modifications.

Acceptance of or agreement to a contract with us, use of any facilities provided, or your signature on any contract shall be considered as conclusive confirmation of your acceptance of these Conditions.

The contents of these terms and conditions are subject to change by us. It is your responsibility to check our site to ensure you are aware of any modifications or changes to the terms and conditions that may apply to you. If you feel a change to the terms and conditions is not acceptable to you or prevents you from continuing with your rental it is your responsibility to let us know. Failure to do so could result in losses for which we are not responsible.

Booking confirmation

Your car rental reservation is not assumed complete or confirmed by any means other than an email from us implicitly confirming your booking. No other confirmation from any other means should be considered as such. Confirmation does not guarantee your reservation.

Delivery & collection charges

Rental price of some Vehicles may be subject to the additional charges which are related but not limited to delivery and collection charges and some other cost which are set by the Supplier may be included in the Total cost of your rental. Any changes related to delivery and/or collection time and/or location may be subject to additional charges.

Delivery and collection charges are made at the sole discretion of the vehicle Supplier and we are not responsible for any losses incurred as a result of these charges. Where possible we will inform you of such charges prior to accepting a booking from you.

Security deposit

In most cases the Supplier will request a security deposit from you before delivery of the vehicle. This deposit is required in case of damage, theft or any other losses to the vehicle. The deposit will be an amount previously agreed with you and will be held on a valid credit card provided by you as specified in Supplier terms and conditions. The amount held will be released without deductions on completion of your rental providing that the vehicle and its contents are returned in the same condition that they were provided to you.

Failure to provide the security deposit could result in the termination of your reservation and the loss of monies already paid. GAT will make no refund if the Client fails to provide security deposit.

Additional drivers

Additional drivers may be added to your rental agreement at the sole discretion of the Supplier. In most cases any additional drivers must be agreed and paid for in advance of delivery. In some instances additional drivers can be added at the time of delivery but these are done so at the sole discretion of the Supplier. Any charges relating to additional drivers are your responsibility. You should inform GAT in advance if any additional drivers will be present and provide required documents for the additional driver.

Rental period

Your rental period will be agreed in advance and will begin and end at the time/date stated on your agreement. A day is considered to be a period of 24 hours.

Extensions to your rental period must be made directly with the supplier who is under no obligation to extend your rental period and may do so at their discretion. The supplier may make additional charges for extensions to the rental period which you are responsible for. We are not responsible in any way for charges made for rental period extensions. No refund will be offered for early return of your vehicle. In some cases an early return will mean additional losses for the Supplier. Any losses incurred by the Supplier due to early return will be your responsibility.

One-way rental

One way rental is usually available but in some cases an extra drop-off charge may be requested by the supplier. Where possible we will inform you of these charges prior to accepting your reservation but this may not always be possible. We are not responsible for any additional charges levied for one-way delivery after booking confirmation. If you are unsure if this is included in your rental agreement, please contact us.

Vehicle extras

In most cases the supplier is able to supply vehicle add-ons. In these cases there will be a surcharge for the supply of the items which will vary between suppliers. We and our suppliers make no guarantee to supply any of the add-ons we mention here or any other vehicle add-on you may request, although every effort will be made to accommodate your request. If you have need any add-ons or you have a special request please add a note before you place your reservation request on the website or inform our CSR before making a reservation.

In some jurisdictions certain add-ons are a legal requirement.In these cases they will be supplied as part of your agreement at no extra charge. The Supplier is responsible to provide and required equipment as specified by state or local laws. Please read Supplier terms and conditions for more details.

Mechanical Difficulties/Accidents

The Supplier shall provide you with an emergency phone number for you to use in the unlikely event of mechanical difficulties or vehicle breakdown. You must call the number as soon as is reasonably possible to ensure no delays in attending to your problem. In the event of a road traffic accident you must contact the Supplier and the local police immediately. It is advised that you keep all the documentation pertaining to the reservation as you may be required to provide it.

Limited liability clause

By using our services, you agree not to hold us responsible for any damages, losses, extra charges or expenses caused in any way by you or the Supplier.

The maximum liability we have to you in cases of failed agreements is to the amount of the payment we’ve received from you at the time of booking only in the case when the vehicle is not delivered in accordance with the agreed terms.

If you have received confirmation of your booking but your rental Supplier fails to provide you the agreed vehicle, fails to offer a suitable alternative or fails to deliver any vehicle we should not be held liable for any such inconvenience or losses incurred and this should be dealt with by you and the Supplier. GAT shall, but is not liable to help in the dispute resolution between you and the supplier, on your costs.

Although every effort has been made to ensure that the information displayed is entirely complete and accurate, GAT holds no liability for any injury to persons, or any loss or damage to property caused by errors or omissions in the data displayed, whether they result from negligence, accident or any other cause.

GAT is not responsible for any incidental expenses or consequential losses that the Customer may have incurred as a result of the cancelled reservation such as visas, airline tickets, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc.

Jurisdiction

Lurento.com is operated by Goldenage Technologies OÜ registered in Estonia. This Agreement shall be governed by and in accordance with the laws of Estonia and any disputes arising shall be subject to the non-exclusive jurisdiction of the courts in Estonia.
